September 20, 2012

ROBERT JOSEPH BUSCHO, 53, of Anaheim was disbarred Sept. 20, 2012, and was ordered to make restitution and comply with rule 9.20 of the California Rules of Court.

Buscho stipulated to multiple acts of misconduct in 18 loan modification matters. He was hired as a senior litigation attorney in 2009 by United Law Group Inc., (ULG), a firm specializing in mortgage loan modifications. He ultimately bought ULG and handled bankruptcy matters as well, employing 35-40 people. Over a few months in 2010, some employees received authorization from some clients to withdraw funds electronically from their bank accounts, and they then converted the funds.

Because of his failure to adequately supervise his employees, Buscho neglected the clients’ cases. For the most part, he was unaware ULG had been retained. Buscho filed for bankruptcy on behalf of ULG and in September 2010, the bankruptcy trustee assumed control over its practice.

Buscho stipulated to numerous counts of failing to perform legal services competently, refund unearned fees. He also violated state law by accepting advance fees for loan modification cases. In three cases, he failed to protect his clients’ interests after he stopped representing them. And he practiced in jurisdictions where he was not licensed.

Buscho agreed to make restitution totaling $52,305.

He has been disciplined three times previously, in 1999, 2001 and 2003, for misconduct including failures to perform legal services competently, refund unearned fees, communicate with a client, or cooperate with the bar’s investigation, and he failed to protect his clients’ interests when his representation ended. He also failed to comply with probation requirements and practiced law while suspended for non-payment of bar dues.

In mitigation, Buscho cooperated with the bar’s investigation, demonstrated remorse and attempted to rein in the ULG employees, who gave him false information. When the bankruptcy trustee took over ULG, Buscho was denied access to its files and was unable to help any of the complaining clients. Several members of his family also face serious health challenges.

April 6, 2003

ROBERT JOSEPH BUSCHO [#122556], 44, of Fullerton was suspended for one year, stayed, placed on two years of probation and was ordered to comply with rule 955. The order took effect April 6, 2003.

He stipulated to three counts of practicing law while suspended for non-payment of bar dues. He made court appearances and filed various notices.

Buscho has been disciplined twice before. In 2001, he was suspended for failing to pay court-ordered sanctions or comply with probation conditions, and in 1999, he was disciplined for failing to perform legal services competently, communicate with a client, return client files, refund unearned fees or cooperate with the bar's investigation and he improperly withdrew from representation.

In mitigation, he cooperated with the bar's investigation, has taken steps to improve his office practices, including reducing his workload, does pro bono work and is the sole support of his 5-year-old daughter, who requires extensive and costly medical care.

November 23, 2001

ROBERT J. BUSCHO [#122556], 43, of Fullerton was suspended for one year, stayed, placed on probation for 18 months with an actual 60-day suspension, and was ordered to make restitution and take the MPRE. If the actual suspension exceeds 90 days, he must comply with rule 955; if it exceeds two years, he must prove his rehabilitation. The order took effect Nov. 23, 2001.

Buscho stipulated that he failed to comply with probation conditions attached to a 1999 disciplinary order: he failed to make restitution, file quarterly probation reports or prove he completed six hours of MCLE courses, and he attended ethics school late.

The discipline was ordered because Buscho failed to perform legal services competently, communicate with clients, refund unearned fees, return client files or cooperate with the bar’s investigation, and he improperly withdrew from employment.

May 8, 1999

ROBERT JOSEPH BUSCHO [#122556], 40, of Glendora was suspended for 90 days, stayed, and placed on 18 months of probation. The order took effect May 8, 1999.

Buscho stipulated to misconduct in two consolidated matters.

In the first, he represented a client who paid $2,000 in advance fees in two civil matters. Buscho never filed the first matter, an action against San Bernardino County for a refund of a property tax penalty. He filed the second, a lawsuit against an escrow company, but judgment was entered in favor of the defendant. Although he opposed a motion for attorneys fees and costs, the appeal was dismissed when Buscho's check for the filing fee bounced. The court later awarded fees and costs of $6,525 to the defendant.

Buscho never informed his client of any of the developments in the second case and failed to respond to the client's requests for information. He abandoned the case, and failed to refund unearned fees or cooperate with the bar's investigation.

He did not cooperate with the investigation of another matter in which his employment was terminated, and he did not return client papers.

In mitigation, Buscho's infant daughter is seriously ill and underwent a heart transplant.
