JOHN EARL MORTIMER [#130526], 51, of Palm Desert was suspended for one year, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect May 1, 2010.

Mortimer stipulated to four counts of misconduct in a workers’ compensation case his client filed against Walmart. When he did not respond to his client’s phone calls and e-mails for more than a year, she hired a new lawyer who asked for the file.

Mortimer stipulated that he did not perform legal services competently, respond to a client’s status inquiries or keep his address current.

Mortimer was publicly reproved in 2007 and stipulated that he did not attend ethics school, as required by his probation. In mitigation, he cooperated with the bar’s investigation and presented evidence of his good character.
