ROBERT ALLEN MARTIN [#62018], 70, of Vallejo was disbarred March 26, 2009, and was ordered to comply with rule 9.20.

In a default proceeding, the State Bar Court found that Martin did not comply with rule 9.20, as ordered in a 2007 discipline. He did not submit an affidavit stating that he notified his clients, opposing counsel and other interested parties of his suspension. Failure to comply with the rule is grounds for disbarment.

In the underlying matter, Martin stipulated that he failed to perform legal services competently, refund unearned fees, or keep his client reasonably informed of significant developments. In mitigation, he had cooperated with the bar’s investigation and was suffering from physical difficulties related to his lung cancer. He also was disciplined in 1988 with a private reproval, imposed for abandoning his client, failing to use reasonable diligence, deliver papers and property to which the client was entitled or communicate with the client.

When he did not comply with a condition of the reproval, he was suspended two years later.

In recommending Martin’s disbarment, Judge Lucy Armendariz wrote, he “has demonstrated an unwillingness to comply with the professional obligations and rules of court imposed on California attorneys although he has been given opportunities to do so.”

ROBERT ALLEN MARTIN [#62018], 68, of Vallejo was suspended for 18 months, stayed, placed on two years of probation with a one-year actual suspension and was ordered to comply with rule 9.20 and take the MPRE. The order took effect Oct. 28, 2007.

Martin stipulated to three counts of misconduct in a matter in which he was hired to seek the reinstatement of his client’s driver’s license. Martin admitted he failed to perform legal services competently, refund unearned fees or keep his client informed about developments in his case.

The client paid Martin $1,500 and although they spoke several times and Martin assured the client his case was “sitting on the judge’s desk,” he in fact never filed any pleadings on his client’s behalf. Martin later told the client there was nothing he could do because the client was not on probation with the DMV.

When the client sought a refund of his fee, Martin said he had contacted a friend who was a traffic commissioner in Sunnyvale and urged the client to speak to that person. When he tried to do so, the commissioner told the client she knew nothing of his case. Martin did not respond to the client’s subsequent letters or phone calls.

Martin was disciplined in 1988 and 1990.

In mitigation, he cooperated with the bar’s investigation, he refunded the client’s fee plus interest and he suffered from lung cancer and had a lung removed.
